These cases are not always cut and dry.  An unfortunate outcome is not always the result of malpractice or negligent care.  All medical treatments have a risk of unwanted complications and side effects; no matter how skilled the treating practitioner is.  One of the biggest complaints by patients involves miscommunication.  Do you have enough medical knowledge to differentiate between a misunderstanding and a true deviation in the standard of care?


product liability

We can help decipher whether the injury was really caused by the product in question or could other factors such as preexisting conditions have contributed to the injury?  Were there breaches in use or standards that are related to the injury?  How severe were the injuries?  Are there long term effects to consider?  


risk management

Risk management nursing is a specialty focused on the legal aspects of medical care. When patient care missteps occur, the LNC works to assess and control the financial and physical issues affecting both the patient and institution. 



Personal injury

We can help differentiate between pre-existing injuries and illnesses and those caused by an accident or through the negligence of others.  There may also be future problems related to that injury that must be recognized.  Injuries with long term effects may require cost projectiosn with the assiatance of life care planning.

 


toxic tort

In this type of case, we can assist in establishing injuries and damages due to vague signs and symptoms.  There could be multiple periods of exposure or exposure to multiple agents. We are trained to assess for subtleties in a symptom reported prior to the exacerbation of a illness.

 


LIfe care planning/estate/financial

In this type of case, the LNC must assess if future healthcare needs are anticipated or planned for.  This involves cost projections, life care plans, etc. 



long-term/elder care litigation

We can assist with everything from injury to long term care issues, disability/estate planning, healthcare billing and medicare.  The elderly population has a high risk of injury from all sources, including abuse/neglect and being used by others for monetary gain.  A LNC is an expert in detecting subtle clues before they become a bigger problem.

 


worker's compensation


Workers’ Compensation is a state program that pays medical expenses and sometimes cash benefits to people who have been hurt on the job. The role of a legal nurse consultant is to read the medical records of claimants, coordinate medical care, and prepare claims for litigation if appropriate.


regulatory compliance

Regulatory compliance is an organization's adherence to laws, regulations, guidelines and specifications relevant to patient care. Violations of regulatory compliance regulations often result in legal punishment, including federal fines.

A LNC can assist in assessing if the story matches the injuries?  Or are there illnesses that could mimic their physical signs of assault?
